The title of this blog is not entirely tongue in cheek as in an opinion filed on July 1, 2008, the Wisconsin Supreme Court eased the consequences of lying on a Real Estate Condition Report in a residential real estate transaction. In Below v. Norton, 2008 WI 77 (http://www.wisbar.org/res/sup/2008/2005ap002855.htm), the court held that the economic loss doctrine bars common-law claims for intentional misrepresentation in all real estate transactions (residential and commercial).

On November 9, 2007, the Securities and Exchange Commission (SEC) gave notice that the National Association of Realtors® (NAR) has asked the SEC for an exemption from securities broker/dealer registration. (Release No. 34-56779; File No. S7-26-07). The requested exemption would permit a licensed real estate agent or broker (Agent/Broker) who is predominantly engaged in and has substantial experience in the commercial real estate market, and the real estate brokerage firm with which such Agent/Broker is licensed, to receive compensation for the sale of a TIC Security.

Mortgage Forgiveness Debt Relief Act of 2007 – Good news on the home front

Signed into law by President Bush on December 20, 2007, H.R. 3648, the Mortgage Forgiveness Debt Relief Act of 2007 (the “2007 Act”), gives some relief to those suffering under a foreclosure and expands the exclusion of capital gains on the sale of a personal residence by a surviving spouse. Are Wisconsin “Dockominiums” Legit? YES, if created before June 1, 2007

In 2002, the Wisconsin Supreme Court said “NO” to Dockominiums, holding that the conversion of a marina to a dockominium form of ownership violated the public trust doctrine because the owner attempted to convey condominium property contrary to Wis. Stat. § 30.133 (1995-96), which prohibits certain transfers of riparian rights. (ABKA Limited Partnership, et. al., vs. Wisconsin Department of Natural Resources et., al., 2002 WI 106).
