Terms and Conditions

You ("You") are requesting that Knight Barry Title, Inc. or one of its affiliated companies, Knight Barry Title Advantage LLC, and Knight Barry Title Services LLC (collectively the "Company"), provide a search of certain public records (the "Search"), as further specified in the request. The Company agrees to perform the Search and provide copies of the documents and information found (the "Documentation") under these terms and conditions.

The Documentation is for informational purposes only. Unless otherwise included in the Documentation, the Search will not include a search for: (1) easements and restrictions of record, (2) marital property rights, (3) current year real estate taxes, (4) special taxes or assessments, and (5) matters not disclosed in the public records, including but not limited to zoning and other ordinances regulating and restricting the use of the subject real property. The Company shall only be liable to You if the Company fails to exercise reasonable care in performing the Search or providing the Documentation; further, the Company's liability shall not exceed $1,000.00 for any and all claims arising out of, or in connection with, the Company's failure to exercise reasonable care in performing the Search or providing the Documentation.

Unless specifically stated otherwise, the Documentation will not be an abstract of title, a title opinion, a title insurance policy or a commitment to issue a policy of title insurance and should not be relied upon in place of such. It is not the intention, express or implied, of the Company to provide any type of guaranty, warranty, or indemnity to You with respect to the accuracy of the Search and/or Documentation. If the Documentation is going to be used by You as the basis of issuance of a title insurance commitment/policy, or if the Documentation is resold or used for foreclosure purposes, You do so at your own risk. In order to obtain information from the Company which will carry the full liability of a title insurance commitment/policy, the Company may issue, if requested, a commitment of title insurance and will charge a fee in compliance with rates filed with the office of the Commissioner of Insurance.
